A Happy Ending For Randy Wolling "AKA" Sage

Today in courtroom #35, at the downtown San Diego courthouse, was a happy day. The deputy DA, was generous, in her plea deal with Randy Wolling. If Mr. Wolling would plead, no contest, to a charge of arriving a half hour early to a state beach, all other charges would be dropped and erased from his file. Judge Woods, also informed Randy, that if he got a job and house and came back to her courtroom in the next few months, she would release him from probation.

Public defender David Knudson explained this to Randy. Randy, thought for a few minutes, about what had just been said. He asked Judge Woods, if she could explain the deal one more time, and she graciously did. Mr. Knudson again talked it over with his client and Randy agreed to the terms. All three charges from the SDPD raid on Oct 28, 2011 will be dropped. Another charge, dealing with lodging at the beach, dismissed.

Randy will be released this evening, and has a year probation. Judge Woods let Randy know if he got a job and found a place to live, she would drop probation. Hey hey, ho ho, our brother Sage gets to go. It's party time! Grab your boots, signs, food and drinks and head over to Freedom Plaza, for the celebration of our fellow occupy brother's, release from occupying a jail cell. Tomorrow night at Freedom Plaza.

A Hung Jury For Randy Wolling Vs.The State

I received a call around 3pm yesterday from Sol, that the jury reached a verdict. I was across the street at specialty coffee on my computer. I quickly turned it off and gather my things and ran out the door. I walked fast to the courthouse located on the other side of the street. Taking off everything that had to go through inspections and put it in my briefcase or backpack, I reached the front entrance. The TSA line was quiet and I past through quickly. Putting everything back on, I headed to the escalator towards the 3rd floor. Speed walking to room #35 I opened the door and was told by Sol, it just began.

Judge Margie Woods went over a few things and then asked the jury foremen, juror #12 the vote for count #1, 6/6. Count #2, 6/6. Count #3 6/6. The judge then asked the foremen if she thought they could discuss it some more and come to a different conclusion. She said No. Judge Woods then asked each of the jury members the same question and they all said No. At this time Judge Woods decided it was a hung jury. A mistrial. She told them at this time they were allowed to discuss the case, but if they were approached to write a book, they needed to wait three months to do so. Judge Woods then thanked the jury and excused them.

Judge Woods talked to council at this time. The deputy DA was concerned that Mr. Wolling would not show up for the next trial and wanted a OR on him. Which is someone being responsible, for Randy showing up at the next trial. Sol told the judge and council he would do that. Judge Woods deceased bail to $1,500 for these counts. Then said, she would reduce bail for the two other charges on his record, to $500 each. Sol was willing to put up $1,500, but that was his limit. Right now Randy is still occupying a jail cell. Sol and I are going to visit him tonight. There is a Tuesday 12/6 appointment at 1:30 in room #35 to discuss an OR and another court date.

Randy Wolling has already spent 35 days in jail. That should account for something To have a retrial on this case, is ridiculous for many reasons and a waste of tax payers money. It is obvious why our country is in such dire straights. People that think they know how to budget money, DON"T, know how too! People that think charges like this, should put people behind bars, have a finger pointing back at them and should also be behind bars. There is something about our judicial system that stinks like horse manure.

Waiting For The Jury and Lords Decision

At 12:15 yesterday afternoon, the jury was excused from the courtroom and escorted by the bailiff to the deliberation room. Once they knew where that was, they would take a lunch break and continue at 1:30.

Judge Margie Woods, gave specific instructions to the jury, at the beginning of the session today. These are a few I wrote down:
1) You must follow the law even if you disagree with it.
2) You must decide if a fact was proved.
3) You must point to innocence, if you believe it could be guilty or innocence.
4) You must judge if information was accurate.
5) How well could witnesses: See, hear, remember, their behavior, consistent/inconsistent, their interest, their biases.
6) You decide if a witness lied or had a conflict of interest.
7) You need to find the defendant guilty beyond a reasonable doubt.

During closing arguments the deputy DA was ridged and rough in her approach, flipping her hair about. She brought a large prop that she dropped onto the easel. The three laws, Randy Wolling supposedly broke, according to her and the police thugs the DA department hangs with, were printed on it. She methodically started her argument with charge #2 Penal Code Section 148 Resisting Delaying or Obstructing Officer. She seemed to scold the jury as she preached her message of guilt for the defendant. Saying at least 130 police officers, each carrying two guns, some had machine guns, batons, pepper spray and at least six pairs of handcuffs could not do their job. What was their job? They arrested 51 protesters out of 75 in 20 minutes. Is that delaying officers and doing their job?

After the deputy DA rested her case, Judge Woods called on public defender David Knudson. An interruption occurred, as Randy Wolling said "He fired his attorney" and started talking about God. Judge Woods called for a recess and asked the jury to leave the room and then the audience. I was so mad at Randy at this point. I could understand his frustration, of being locked up like an animal for 35 days and scared that he might not get out. But he could have received contempt of court. Thankfully Judge Woods did not give him that.

We walked back into the room, after public defender David Knudson already started his closing arguments. He made sure the jury knew, that the witnesses who testified, contradicted themselves throughout their testimony. He told the jury that officer Goebel did not remember who helped him arrest Randy or who filled out the other half of the police report. Lt. Mitchell stated that police closed off 3rd & B st immediately after they approached civic ctr, for the safety of the public. David Knudson made it clear that Randy Wolling was woken by police on this morning and they herded them to the street without giving them time to gather their belongings like they said they did. David told the jury "this is what democracy looks like" and you are to find Randy Wolling Not Guilty because there is no evidence and consistent facts proven beyond a reasonable doubt.

As we wait for the verdict, what have we learned in this case. Police Lie! Police are not your friends! Police are above the law until proven otherwise. Lt Mitchell talked much about illegal lodging, but Randy was not charged with that, why? Both Lt. Mitchell and Officer Goebel, talked about the unsanitary and safety conditions at the plaza and the rats. The only rats at the plaza are the police officers. They methodically put up barricades, to intimidate people from entering freedom plaza and cause a fire hazard situation. They sneak around, looking for anything to harass you for, or arrest you. These dirty rats have multiplied like varmints that need to be exterminated! Lord where are you?

Will Justice Prevail Today For Randy Wolling "AKA" Sage?

The deputy DA rested the people's case yesterday afternoon. Then the public defender did the same. Judge Woods called for a ten minute recess at this time. Standing outside the courtroom Mr. Knudson walked up to us and said "Randy wants to testify." I looked at Sol and we both shook our heads no. I was happy at the outcome so far in the case and so was Sol.

Randy Wolling was charged on Friday Oct 28, 2011 at 2:20am with three counts. Resisting arrest, illegal lodging, and unlawful assembly. He has been occupying a jail cell ever since. The evidence we heard yesterday from Lt David Mitchell and police officer Goebel did not prove beyond a reasonable doubt that Mr. Wollling was guilty. I was in this raid and both these officers lied under oath.

The deputy DA played video's for Lt Mitchell and he could not identify Randy in any of them. These video's were a joke. What an embarrassment for Mitchell. Lt Mitchell claims he knew what all 90 officers were doing and saying the entire night of the raid. All though he could not identify Randy Wolling the man they arrested in these video's. I started laughing to myself when Lt. Mitchell said, the raid team surrounded the food table the night of the raid first, in case we used the food utensils as weapons against the police. That is a LIE! I was sleeping in the medic tent directly next door and they NEVER surrounded the food tent.

Police officer Goebel who arrested Randy Wolling the morning of Oct 28, 2011 took the stand. He again brings up the subject of unsanitary conditions at the civic center. He mentioned the grounds keepers have had a hard time doing there job at civic center. I have been a 24/7 occupier and I have seen the grounds keepers once out there working, until yesterday. They have Not been doing their job! Officer Goebel stated he never personally told Randy Wolling he needed to leave, but he did hear others do that, but could not give their names. Officer Goebel filled out a police report, that was also completed by another officer, he did not know. Officer Goebel never listed in his report  Mr. Wolling had his arms locked with others. He never listed in his report any municipal codes Randy broke the law for. He did not type his report or read it afterwards.

Randy Wolling took the stand. He told the people in the room he was called by his Lord to the Occupation. That it was Gods will for him to be there. That he follows Gods will and not man's law. When the deputy DA cross examined him she said "So you follow Gods law and Not man's law." Randy said "No I follow Gods will not mans law." The second time the public defender went to examine Randy, judge Woods continued to over rule everything he asked Randy. The same questions just posed by the deputy DA. It is extremely obvious judge Woods discriminates and does not abide by the oath she took under the constitution.

As I left the courtroom yesterday I was very frustrated. During Randy's testifying he said something that made me laugh. The bailiff came up to me and said, I was being disrespectful to the judge. I was so pissed. I am not sure if Randy should have took the stand, but that was his choice, not mine. I tried to get him bailed out of jail, but due to prior tickets that did not happen. Today court resumes at 9:30am and we should find out the verdict sometime today. I am not a believer, but for my friend Sage I hope his Lord is on his team and finds him innocent so he can leave the confines of a judicial system that stinks of corruption.

Sitting in A Jail Cell, Because He Peacefully Sat at A Protest

Day Thirty three in jail, behind bars with no independence, because he was protesting for change, peace and a better America. Randy Wolling "AKA" Sage is on trial for peacefully assembling, resisting arrest and illegal lodging. Yesterday in courtroom #35 at the downtown San Diego courthouse, we watched video from the second raid on occupy San Diego by the SDPD.

The video showed a quiet Randy sitting on a curb with three other occupiers detained by the SDPD. Were they sitting there, because they did not want to get into the paddy wagon? Or were they sitting there because they were told to by the SDPD? To me in the video it looks like they were told to sit there until further notice of being escorted to the paddy wagon.

The assistant DA asked the judge to exclude sound, from all video's presented, except the one. The one the assistant DA wants to allow is the head police officer telling protesters to leave or they would be arrested. But in the other video's what they are saying or not saying is important to this case also. It seemed evident to me, in the courtroom, that judge Woods and the assistant DA had a bond.

That is exactly why the 99% are as mad as hell. Because of the injustice by our judges, politicians, corporate owners and the 1%. Thank goodness this is a jury trial and the people not the court will make the final decision, on our Occupy brother Sage's future. The amount of money the city is spending on this inhumane action, is ridiculous. The assisant DA's demeanor is that of an angry soul, out to get Osama Bin Laden.
